1. Scope of Application
These Terms and Conditions apply to all services provided as part of the online language training between the Language Trainer and the Participant.

2. Description of Services
(1) The Language Trainer offers individual online language training for adults with aphasia.
(2) Training is generally conducted as one-to-one sessions via Zoom video conferencing.
(3) A training session typically lasts 60 minutes.
(4) The content and structure of the training are tailored to the individual participant. No specific outcome or success is guaranteed.
(5) This service does not constitute speech-language therapy or medical treatment and does not replace medically prescribed therapy.

3. Conclusion of Contract
(1) The contract is concluded through an individual agreement (e.g., by email).
(2) The specific terms, including fees and scope of services, are agreed individually and documented in the participation agreement.
(3) By entering into the contract, the Participant accepts these Terms and Conditions.

4. Fees and Payment Terms
(1) Fees are based on the individually agreed conditions.
(2) Services are self-funded and are not covered by statutory or private health insurance.
(3) Invoices are generally issued monthly unless otherwise agreed.
(4) Invoices are payable within 14 days without deduction.

5. Scheduling and Cancellation
(1) Appointments are arranged individually.
(2) Cancellations are free of charge if made at least 24 hours before the scheduled session.
(3) For cancellations made later than 24 hours before the appointment or in the event of non-attendance, the full agreed fee will be charged as a cancellation fee.
(4) Late arrival does not entitle the Participant to an extension of the agreed session time. The agreed fee remains payable in full.
(5) No refund will be provided for technical problems on the Participant’s side.

6. Conduct of Training and Technical Requirements
(1) Training sessions are conducted online via Zoom Communications.
(2) Participants are responsible for ensuring a stable internet connection and appropriate technical equipment.
(3) No refund will be provided for technical issues on the Participant’s side.

7. Liability
(1) The Language Trainer shall have unlimited liability for damages arising from injury to life, body, or health, as well as for damages resulting from intentional misconduct or gross negligence.
(2) In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), liability shall be limited to foreseeable damages typical for the contract. Essential contractual obligations are those whose fulfilment is necessary for the proper performance of the contract and on whose compliance the Participant may regularly rely.
(3) Any further liability of the Language Trainer is excluded to the extent permitted by law.
(4) No liability is assumed for the absence of individual progress or training outcomes.
(5) The training provided does not constitute a medical diagnosis or medical treatment and does not replace medically prescribed therapy.

8. Health Notice
(1) The service is intended for individuals who do not have acute medical conditions that would prevent participation.
(2) If in doubt, Participants are advised to seek medical advice before participating.
(3) Providing an emergency contact is voluntary. If no emergency contact is provided, responsibility for accessibility and medical support remains solely with the Participant.

9. Data Protection
(1) Personal data will be processed exclusively in accordance with applicable data protection laws.

10. Duration and Termination
(1) Either party may terminate the contract at any time in text form (e.g., by email).
(2) Previously scheduled appointments remain unaffected unless otherwise agreed.

11. Right of Withdrawal
You have the right to withdraw from this contract within 14 days from the date of conclusion of the contract without giving any reason.
To exercise your right of withdrawal, you must inform me (Jennifer Heiming-Al Yosef, email: info@yourwordpath.com) of your decision to withdraw from the contract by means of a clear statement (e.g., by email).
If you expressly request that the training begins during the withdrawal period, you acknowledge that your right of withdrawal may expire upon full performance of the contract.
In the event of withdrawal before full performance of the contract, a proportionate amount will be charged for services already provided.

12. Final Provisions
(1) The laws of the Federal Republic of Germany shall apply.
(2) Should any provision of these Terms and Conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
